THE STOP

The initial traffic stop is the first way to attack against your charge.  The state must show that the officer had a good reason for stopping your car.  In the case of an accident, your defenses are a little more limited and the help of an attorney is more strongly recommenced.

Regular traffic tickets are the usual reason given to stop most motorists.  The cop comes up with an excuse (pretext) for pulling over a driver.  This could range from speeding or improper lane usage (weaving or changing lanes) to a burned out tail light.  But once the officer comes up with an excuse to stop a vehicle the arrest begins.

Beat the traffic stop and you beat the DUI/DWI.  If the traffic stop gets thrown out the drunk driving charge also gets thrown out.  Unfortunately, the judges will often cover for the so you should get an attorney who specializes in handling DUI/DWI cases.

But the odds are against you if you go it alone.  DUI/DWI charges are a big source of revenue for local governments.  Your best chance of beating the charge is a qualified, local attorney who knows the ins and outs of the court.
